DECISION
TRANSFERRING TASKS AND POWERS OF LAND VALUATION, DOSSIERS, DOCUMENTS, ORGANIZATIONS AND OFFICLALS AND PUBLIC EMPLOYEES CONDUCTING LAND VALUATION FROM THE FINANCE TO THE NATURAL RESOURCES AND ENVIRONMENT SECTOR
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on the Organization of the Government,
Pursuant to the Government’s Decree No. 25/2008/ND-CP of March 4, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Natural Resources and Environment Minister, the Finance Minister and the Home Affairs Minister,
DECIDES:
Article 1. To transfer from the finance to the natural resources and environment sector:
1. Tasks and powers of land valuation.
2. Dossiers and documents dated from January 1, 2006, to the end of November 30, 2008, printed or electronic, including dossiers and documents on land valuation and other land valuation-related dossiers and documents; statistical reports on land prices; and programs, schemes and projects on land valuation.
3. Organizations (if any), officials and public employees conducting land valuation under the Ministry of Finance, provincial-level Finance Services and district-level Finance Sections.
Article 2. Organization of implementation
1. The Ministry of Natural Resources and Environment shall assume the prime responsibility for and coordinate with the Ministry of Finance and the Ministry of Home Affairs in, organizing the implementation of, and monitoring and urging provincial-level People’s Committees to implement, Article 1 of this Decision.
2. The Ministry of Finance, the Ministry of Natural Resources and Environment and provincial-level People’s Committees shall accomplish the implementation of Article 1 of this Decision before December 15, 2008.
3. In the course of transfer, normal land valuation operations at all levels must be ensured.
4. The Ministry of Home Affairs shall revise and supplement administrative payrolls for land valuation work in the natural resources and environment sector under law.
5. The Finance Minister, the Home Affairs Minister and presidents of provincial-level People’s Committees shall report’ on the implementation of this Decision to the Prime Minister (also to the Ministry of Natural Resources and Environment for sum-up and reporting to the Prime Minister) before December 31, 2008.
Article 3. Implementation effect and responsibility
1. This Decision takes effect on the date of its signing.
2. The Finance Minister, the Home Affairs Minister, the Natural Resources and Environment Minister, the Minister-Director of the Government Office, presidents of provincial-level People’s Committees, and concerned organizations and individuals shall implement this Decision.
