Official Dispatch No. 1768/TCHQ-GSQL dated April 8, 2013 of the General Department of Customs to seal  the confirmation “Customs procedure is done”

On answering the Official Dispatch No. 90/HQĐNa-GSQL dated January 16, 2012 of the Customs Department of Dong Nai on the case that customs officers only seals on the confirmation of finishing import customs declaration exempted from actual inspection of goods and finish customs procedures for the declaring party after the time that goods arrive in the port (basing on the arrival notice or manifest owns the customs seal on confirming transportation mean to the port. The General Department of Customs has opinions as follows:

 Pursuant to the regulations at Article 18, Article 25 of the Law on amending, supplementing some articles of the Law on Customs in 2005; Article 10 of the Decree No. 87/2012/ND-CP dated October 23, 2012 of the Government; Article 25 of the Circular No. 194/2013/TT-BTC dated December 06, 2010, step 3, Part 1 of the Customs procedure process for commercial import and export goods issued with the Decision No. 1171/QD-TCHQ; Article 9 of the Circular No. 196/2012/TT-BTC dated November 15, 2012 of the Ministry of Finance, the petition of the Customs Department of Dong Nai is not suitable with above regulations and creates no favorable conditions for enterprises in export and import. Therefore, the Customs Department of Dong Nai is suggested to implement in accordance with current legal regulations.

The General Department of Customs answers the Customs Department of Dong Nai for acknowledgement and implementation./.
