DECISION
AMENDING AND SUPPLEMENTING THE PRIME MINISTER’S DECISION NO. 62/2009/QD-TTG DATED APRIL 20TH 2009 ON THE EXEMPTION FROM THE RENT FOR LAND FOR BUILDING MAINTENANCE STATIONS AND PARKING LOTS OF THE ENTERPRISES THAT PROVIDE PUBLIC TRANSPORTATION SERVICES
Pursuant to the Law on Government organization dated December 25th 2001;
Pursuant to the Law on Lad dated November 26th 2003;
Pursuant to the Government's Decree No. 142/2005/ND-CP dated November 14th 2005 of the collection of the rent for land and water surface;
Pursuant to the Decision No. 280/QD-TTg dated March 08th 2012, approving the scheme for the development of pubic transportation by bus 2012 - 2020;
At the proposal of the Minister of Finance;
The Prime Minister issues the Decision on the exemption from the rent of land for building maintenance stations and parking lots of the enterprises that provide public transportation services;
Article 1. Amending and supplementing Article 1 of the Prime Minister’s Decision No. 62/2009/QD-TTg dated April 20th 2009 as follows:
“Article 1. The enterprises established and operated in accordance with the Law on Enterprises and the Law on Cooperatives that are given land by the State for providing public transportation services in districts, cities, and towns in central-affiliated cities and provinces are exempted from the land rent for the entire rent period, applicable to the land area used for building maintenance stations and parking lots (including ticket booths, managerial areas, and public areas) serving the provision of public transportation services.
For enterprises that provide public transportation services by bus, the land rent exemption stated above is also applicable to all localities without any limitation in the districts, cities, and towns in central-affiliated cities and provinces ..
The land area not being used for the purposes stated above (if any) is not exempted from land rent as prescribed by current regulations.”
Article 2. Implementation provisions
This Decision takes effect on February 15th 2013.
Article 3. Implementation organization
The Minister of Finance, the Presidents of People’s Committees of central-affiliated cities and provinces, the Ministers, the Directors of relevant agencies are responsible for the implementation of this Decision.
